Terms of Service

Effective Date: 1 January 2026

1. Agreement to Terms

By submitting an enquiry, making a booking, or using our services, you agree to these Terms of Service. "Cape Experiences," "we," "us," and "our" refer to Cape Experiences (Pty) Ltd, registered in South Africa. "You" and "your" refer to the person making the booking and all travellers included in that booking.

The lead traveller (person making the booking) accepts these terms on behalf of all travellers in their party and is responsible for communicating these terms to them.

2. Our Services

We are a travel planning and booking service specialising in sports tourism and adventure experiences in South Africa's Western Cape region. We act as an intermediary between you and third-party service providers including:

  • Accommodation providers
  • Transport and transfer companies
  • Activity and tour operators
  • Sports venues and event organisers
  • Golf courses and clubs
  • Restaurants and hospitality venues

Each booking is customised to your requirements. Quoted prices are estimates until confirmed in writing.

3. Quotations and Pricing

  • All prices are quoted in South African Rand (ZAR) unless otherwise stated
  • Quotes are valid for 14 days unless specified otherwise
  • Prices may vary due to currency fluctuations, supplier price changes, or availability
  • Final pricing is confirmed upon receipt of deposit
  • Prices include services explicitly listed in your itinerary; all other costs (flights, visas, travel insurance, personal expenses, gratuities) are your responsibility unless stated

4. Booking and Payment

Deposit

A non-refundable deposit of 30% of the total package price is required to confirm your booking. For bookings including major sporting events or peak-season dates, a 50% deposit may be required.

Final Payment

The balance is due 60 days before your arrival date. For bookings made within 60 days of arrival, full payment is required at the time of booking.

Payment Methods

We accept bank transfers (EFT), credit cards (Visa, Mastercard), and PayPal. Credit card payments may incur a processing fee of up to 3.5%.

Late Payment

Failure to pay by the due date may result in cancellation of your booking, with cancellation fees applied as per Section 5.

5. Cancellation Policy

Cancellation by You

If you cancel your booking, the following fees apply based on the date we receive written notice:

  • More than 60 days before arrival: Loss of deposit only
  • 30–60 days before arrival: 50% of total package price
  • 15–29 days before arrival: 75% of total package price
  • Less than 15 days before arrival: 100% of total package price

Some components (sporting event tickets, peak-season accommodation) may have stricter cancellation terms imposed by suppliers. These will be communicated at the time of booking.

Cancellation by Us

We reserve the right to cancel your booking if:

  • Payment is not received by the due date
  • Circumstances beyond our control make it impossible to deliver the services (see Force Majeure)
  • Your conduct poses a risk to yourself, other travellers, or our staff

If we cancel for reasons other than non-payment or conduct, you will receive a full refund or the option to rebook.

6. Changes and Amendments

Changes by You

We will do our best to accommodate changes to your itinerary. Requests must be made in writing. An administration fee of R500 may apply, plus any additional costs from suppliers. Changes within 30 days of arrival may not be possible.

Changes by Us

Occasionally, we may need to make changes to your itinerary due to supplier availability, weather, or other factors. We will notify you as soon as possible and offer comparable alternatives. If a significant change occurs before departure, you may cancel for a full refund.

7. Travel Insurance

Travel insurance is mandatory. You must have comprehensive travel insurance covering:

  • Trip cancellation and interruption
  • Medical expenses and emergency evacuation
  • Personal liability
  • Loss of luggage and personal belongings
  • Adventure activities (if participating in high-risk activities)

We may request proof of insurance before departure. We are not responsible for any losses arising from inadequate insurance coverage.

8. Health, Fitness, and Safety

Some activities require a reasonable level of fitness or have age/health restrictions. You are responsible for:

  • Ensuring you meet the physical requirements for your chosen activities
  • Disclosing any medical conditions, allergies, or dietary requirements
  • Following safety instructions from guides and operators
  • Obtaining necessary vaccinations and medications
  • Checking travel advisories for South Africa

We reserve the right to exclude you from activities if, in our reasonable judgment, your participation poses a safety risk.

9. Liability

We act as an agent for third-party service providers. While we carefully select our partners, we are not liable for:

  • Acts, omissions, or negligence of third-party suppliers
  • Injury, illness, death, loss, or damage arising from your travel
  • Delays, cancellations, or changes caused by suppliers, weather, or events beyond our control
  • Loss or theft of personal belongings

Our liability, where applicable, is limited to the cost of the services we directly provided. Nothing in these terms excludes liability for death or personal injury caused by our negligence or fraud.

10. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to: natural disasters, war, terrorism, civil unrest, epidemics/pandemics, government actions, strikes, severe weather, or supplier insolvency.

In such events, we will work with you to reschedule or provide credit for future travel. Refunds will depend on what we can recover from suppliers.

11. Complaints

If you have a complaint during your trip, please notify us immediately so we can attempt to resolve it. Contact our 24/7 emergency line provided in your travel documents.

Complaints made after your return must be submitted in writing within 28 days of your return date. We will investigate and respond within 28 days of receiving your complaint.

12. Intellectual Property

All content on this website—including text, images, logos, and itinerary designs—is owned by Cape Experiences or our licensors. You may not reproduce, distribute, or use our content without written permission.

13. Governing Law

These terms are governed by the laws of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.
